Testing draft: public launch is pending confirmed operator details, privacy contact and legal review.

# OhmyCV Terms of Service — launch draft Prepared: 28 September 2026. Effective date: [COMPLETE BEFORE PUBLICATION]. **Draft for review, not yet published or accepted by users.** The registration correspondence reviewed on 4 October 2026 proposes Point Monk Pvt Ltd, with Shinto Joseph and Robinson John Moozhayil as directors, for IT products and IT services in Bangalore, Karnataka, India. The thread ends at a payment request to proceed; it is not evidence of incorporation or name approval. The registered entity name, certificate/CIN, address and privacy contact remain unverified. Complete every bracketed field, verify all operational promises, and have qualified counsel review the terms for the actual operator and markets. These terms cannot eliminate statutory duties or liability. ## 1. Operator and agreement OhmyCV is a product offered under the Pointmonk brand by [FULL LEGAL NAME OF INDIVIDUAL OR ENTITY], located at [REGISTERED STREET ADDRESS], Bangalore, Karnataka, India (“we”, “us”). Pointmonk's website is https://pointmonk.com. Brand names alone do not identify the contracting person. These Terms govern your use of OhmyCV. When you affirmatively accept them during registration or another clearly identified acceptance step, you agree to them. Our Privacy Policy explains personal-information processing; accepting these Terms is not blanket consent to optional data use. If you do not agree, do not create an account or submit content. Support: [VERIFIED SUPPORT EMAIL]. Privacy and rights requests: [VERIFIED PRIVACY EMAIL / REQUEST URL]. ## 2. Eligibility and accounts For the initial launch, the service is intended for people at least 18 years old who can lawfully enter this agreement. If the age of contractual capacity in your jurisdiction is higher, you must meet it. Do not use another person's account or misrepresent your authority. Keep account credentials secure and promptly report suspected unauthorized access. [LAUNCH CONTROL: implement an appropriate age/eligibility flow and handling for known minors. A sentence in these Terms is not an age-verification system.] Guest features, if offered, may have limited persistence. Any guest expiry period will be clearly displayed. Export a copy of work you wish to retain. ## 3. What the service provides OhmyCV helps you create, edit, design, tailor and download CVs. You are responsible for the accuracy of your qualifications and for reviewing formatting and content before sharing. Templates, ATS estimates and AI suggestions do not guarantee employment, interviews, recruitment-system acceptance or a particular score. We are not your employer, recruiter, legal adviser or agent. Unless a feature expressly says otherwise and you authorize it, we do not submit your CV to employers. ## 4. Free service, advertising and credits The launch service is free and supported by advertising. Some features may have usage limits or require promotional credits. Before an ad-supported action, the interface will state the credit requirement and qualifying completion condition. Watching an optional rewarded ad does not authorize unrelated personal-data use. You can stop an ad; incomplete viewing may not earn credits. Ad completion and credits can be checked for fraud. If a technical failure prevents a valid reward, contact support for review. Promotional credits have no cash value, cannot be sold or transferred, and are not deposits or stored money. Any expiry or material limit must be disclosed before it applies. We may change future promotional offers and availability, with reasonable notice for material changes where practicable and as required by law. No payment is authorized merely by using the free service. Any future paid product will require separately disclosed pricing and affirmative purchase authorization. Advertisements are identified as advertising. An ad is not an endorsement. Advertisers' sites are subject to their own terms and privacy practices; this does not reduce our responsibility for our own conduct or disclosures. ## 5. Your content and limited permission You retain ownership of the content you upload or create, subject to third-party rights. You give us a non-exclusive permission to store, reproduce, format, process and transmit that content only to provide requested features, maintain security, resolve support issues, comply with law and carry out the specifically disclosed purposes in our Privacy Policy. The permission does not transfer ownership of your CV, permit sale of personal information, or authorize unrelated advertising profiles or general-purpose model training. It ends when the relevant content is deleted, except for limited lawful retention and backup expiry described in the Privacy Policy. Upload only material you are entitled to use. Obtain permission before providing another person's private information, such as a reference's personal contact details. Do not upload government identification numbers, banking details, passwords, health records or other unnecessary sensitive information. ## 6. AI features When you request AI assistance, the relevant inputs may be sent to the named AI processor described in the Privacy Policy and in the feature notice. Outputs may contain errors, omissions or invented statements. Check them and do not use inaccurate claims. An AI processor is an external recipient even if the feature is described as “internal improvement.” Optional research or training requires a separately reviewed arrangement and any required separate consent; it is not authorized by these Terms. ## 7. Permitted use You may use the service and export your own CV for lawful purposes. Do not upload malware, impersonate others, violate privacy or intellectual-property rights, attempt unauthorized access, circumvent quotas or reward validation, or use automated requests that materially disrupt the service. We may investigate suspected abuse using proportionate measures and the data uses disclosed in our Privacy Policy. We may restrict an account for security, legal compliance or material breach. Where lawful and safe, we will explain the restriction and provide a contact for review. ## 8. Platform materials We or our licensors own the service's software, branding and template designs. We grant you permission to use the service and incorporate selected templates into CVs you lawfully create and distribute. This does not grant permission to resell the template library, impersonate the brand or redistribute the software. Rights that applicable law requires us to allow remain unaffected. ## 9. Availability, changes and ending use We may maintain, improve or discontinue features. We will provide reasonable advance notice of material discontinuation where practicable so you can export your content. Urgent security or legal action may require immediate changes. You may stop using the service and request account closure at any time through the Data choices page at /privacy-settings/. Closure does not erase data subject to a valid legal obligation or hold; such retained data will be restricted to that purpose. The Privacy Policy explains active-store deletion and backup retention. ## 10. Warranties and responsibility We will exercise the care required by applicable law. Subject to those rights, the service and AI outputs are supplied on an “as available” basis without a promise of uninterrupted or error-free operation, fitness for a particular job application, or employment results. To the extent applicable law permits, we are not responsible for indirect or consequential losses arising from use of the service. This clause does not exclude or limit liability that cannot lawfully be excluded, including applicable consumer guarantees, privacy obligations, fraud, intentional misconduct or other non-excludable liability. No zero-dollar liability cap, mandatory arbitration, class-action waiver or broad user indemnity is included in this draft. Any additional limitation needs jurisdiction-specific legal review rather than assuming that free access removes legal responsibility. ## 11. Disputes and applicable law Please contact [LEGAL CONTACT] so we can try to resolve a concern. This is not a requirement to give up a complaint to a privacy regulator, consumer authority or court. Subject to mandatory laws protecting you, these Terms are governed by [CONFIRMED GOVERNING LAW], and disputes may be brought in [CONFIRMED VENUE]. Nothing removes a forum, remedy or consumer right that applicable law makes available to you. ## 12. Changes and general provisions We will date updated Terms and provide notice of material changes. Where required, we will ask for fresh acceptance before they apply. We will not use a policy update alone to retroactively authorize a materially different use of previously collected personal information. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A delay in exercising a right does not waive it. These Terms do not limit any right that cannot lawfully be waived. ## Publication checklist (internal; remove from public text) - Replace operator, effective date, jurisdiction and all contact placeholders. - Implement acceptance records with version and timestamp; link Privacy Policy separately. - Verify age handling, credit rules, termination/export procedure and rights channel. - Ensure the actual ad SDK and AI vendor practices match the Privacy Policy. - Provide legally required language versions, including Quebec review where applicable. - Counsel approval and a dated record of technical/privacy checks.
